When ordering M&P’s international services you, as “Shipper”, are agreeing, acknowledges and accepts on your behalf and on behalf of the consignee of the Shipment and anyone else with an interest in the Shipment that these Terms and Conditions shall apply and you shall relive & indemnify M&P Express Logistics (Pvt.) Limited (“M&P”) from all types of liabilities, responsibilities, claims, civil or criminal proceedings by any Government Agency, Suits, Petitions etc. against any damage, loss or expense suffered in connection with the services rendered hereunder The Shipper will be bound by the signature of any of its employees, servants, and agents on the (Air) Waybill. It is undertaken by shipper client that All shipments/items are legal commodity and is allowed by Pakistani and International law and does not contain any banned/contraband &dangerous/hazardous items.

Terms & conditions
Address correction or address change surcharge of USD 15 per shipment will be charged E-Form processing charges for export shipments using Web portal/ software/ program will be charged at USD 5 per shipment. Change of billing Surcharge of USD 35 will be applied when a customer requests a change of defined billing information on an already issued invoice, Neutral Delivery charges will be charged of USD 5 per shipment for an optional delivery service, allowing the shipper or importer to maintain confidentiality over the declared value of the goods Multiline charges of USD 6 per line will be applied when more than 5 lines are recorded on the customs clearance airwayble with multiple commodities or multiple origins for the same commodity Dedicated delivery surcharge minimum USD 10 will be applicable if a customer’s request, an immediate or non-routine delivery of a shipment within a normal working day or a holiday that involves a specific vehicle or more than one courier Clearance Data Modification charge of USD 60 per shipment will be charged in case of addition or modification of data declared to Customs Authorities for clearance purposes such as declared values, classification of the goods, importer details, based on documentary evidence gathered from or confirmed by the Importer or Exporter and only upon request by customs authorities or at the request of the Importer/Exporter.

M&P Consignment Note:
The Consignment Note of M&P (CN/CWB/HAWB) is non-negotiable, and the Shipper/Sender (s) acknowledges that it has been prepared by the Shipper/Sender (s) or by M&P staff on behalf of the Shipper. The Shipper/Client (s) confirms, affirm that all the information provided to M&P while booking the shipment are complete, correct & true including Shippers and Consignee details, value declaration of goods etc. In case of any incorrect information or declaration in the CN/CWB/HAWB, the Shipper/Client (s) acknowledges, affirms & agrees that M&P will be absolved from all types of liabilities, responsibilities pertaining to loss, damage or expense suffered by the Shipper/Client (s) and shall be indemnified by shipper in all legal forums. “Shipment” means all documents or parcels that travel under one waybill, and which may be carried by any means M&P chooses, including air, road, or any other carrier. Every Shipment is transported on a limited liability basis as provided herein. If Shipper requires greater protection, then insurance may be arranged at an additional cost.

No Variation:
These terms and conditions are applicable on all courier and logistics services provided by M&P to the Shipper/Client (s) hereunder. No employee, franchisee, agent of M&P or anyone else has any authority to change any of these terms and conditions or make any promise on behalf of M&P which is in addition to or conflict with these Terms and Conditions. The carriage by air of a Shipment may be subject to the Warsaw Convention of October 12, 1929, as amended by the Hague Protocol of September 28, 1955 and all subsequent applicable Protocols or the Montreal Convention of May 28, 1999 and all subsequent applicable Protocols, as well as the Guadalajara Convention of September 18, 1961. Shipments transported partly or solely by road - by explicit agreement or otherwise - in, to or from a country which is party to the Convention on the Contract for the International Carriage of Goods by Road, as amended, are subject to the terms and conditions thereof. Shipments carried from and between specified locations within one country are subject to the mandatory rules provided by the laws of that country.

Inspection:
M&P has the right to open and inspect a Shipment without notice for safety, security, customs, or other regulatory reasons.

Limitation of Liability:
Maximum Liability on Non-Document shipments in case of total loss is US$ 100 per shipment irrespective of weight or volume. Maximum Liability on Non-Document shipments in case of total damage is US$ 100 per shipment irrespective of weight or volume. Maximum liability on non-Document shipments in case of partial loss or partial damage, US$ 50 or declared value Only) per shipment; whichever is less. In case of damage, the liability will be assessed on the affected material and the goods shall be handed over to M&P, in lieu of payment against those goods. Maximum liability in case of shipment comprising of document and lost in transit shall be free of cost delivery of replaced / reconstructed documents OR refund of booking charges to shipper.

A Shipment shall not be booked if::
• No customs declaration is made where in terms of value or clear description of contents required by applicable customs regulations.
• it contains counterfeit goods, animals, bullion, currency, gem stones; weapons, explosives and ammunition or their parts, human remains; illegal items, such as ivory and narcotics, cement, MONEY (coins, cash, currency paper money and negotiable instruments equivalent to cash such as endorsed stocks, bonds and cash letters), COLLECTABLE COINS AND STAMPS, shipments to APO / FPO addresses, CASH ON DELIVERY SHIPMENTS, foodstuffs, perishable food articles and beverages requiring refrigeration or other environmental control, pornography and/or obscene material: letter of credits, shipments requiring M&P to obtain any special license op permit for transportation, importation or exportation;, shipments the carriage, importation or exportation of which is prohibited by any law, statute or regulation;
• If the Shipment is held by customs authorities for any reason whatsoever or consignee refuses to receive the shipment or refuses to pay Customs Duties or other Shipment charges, M&P shall use reasonable efforts to return the Shipment to Shipper at Shipper’s cost, failing which the Shipment may be disposed-off at destination without incurring any liability whatsoever towards M&P.
• If shipper wants his shipment to be returned after booking due to any valid reason and shipment is still not uplifted to international destination, the shipment will be returned to the shipper after getting written request and local transportation charges will be deducted from the charges paid by the shippers OR will be invoiced to the shipper in case of corporate customer.
• it is classified as hazardous material, dangerous goods, prohibited or restricted articles by IATA (International Air Transport Association), ICAO (International Civil Aviation Organization), ADR (European Road Transport Regulation on dangerous goods) or other relevant organization (“Dangerous Goods”),

Refusal Or Rejection Of Shipments:
M&P reserves the right to refuse, hold, cancel, postpone or return any Shipment at any time if such Shipment is in the opinion of M&P likely to cause damage or delay to other Shipments, goods or persons, or the carriage of which is prohibited by law or is in violation of any of these Conditions, or the M&P Account of the person or entity responsible for payment is not in good credit standing. The fact that M&P accepts a Shipment does not mean that such Shipment conforms to applicable laws and regulations or to the present Conditions. If the Shipment is deemed to be unacceptable as described or it has been undervalued for customs purposes, or Receiver cannot be reasonably identified or located, or Receiver refuses delivery or to pay Customs Duties or other Shipment charges, M&P shall use reasonable efforts to return the Shipment to Shipper at Shipper’s cost, failing which the Shipment may be disposed of or sold without incurring any liability whatsoever to Shipper or anyone else, with the proceeds applied against Customs Duties, Shipment charges and related administrative costs with the balance of the proceeds of a sale to be returned to Shipper. M&P shall have the right to destroy any Shipment which any law prevents M&P or any service provider from returning to Shipper as well as any Shipment of Dangerous Goods.

Liabilities:
Regardless of any payment instructions or provisions to the contrary, the shipper shall always remain ultimately liable for the charges including duties and taxes, if any. The shipper is responsible for making sure goods shipped are acceptable for entry into the destination country. All Charges for shipment to and return from countries where entry is not permitted are the shipper's responsibility. It is the Shipper's responsibility to ensure that all necessary documentation in addition to the (Air) Waybill is provided and accurately completed in compliance with all applicable laws, rules and regulations. M&P shall not be liable in any circumstances for any claim, which relates to seizure or detention of goods in the course of transit by Customs or other government authorities. ‘M&P will not be liable in any event for special, incidental, consequential, indirect losses or damages, including but not limited to loss of income, profits or business.

Claims for loss or Damage:
All claims due to loss or damage must be notified to M&P in writing within 30 calendar days after delivery of the Shipment, failing which no action for damages will be brought against M&P Severability The invalidity or unenforceability of any provision shall not affect any other part of these Terms and Conditions.

Shipment Return Policy:
If the shipment is physically returned from the destination country due to issue in consignee contact details/ non-availability of consignee, refusal of consignee to accept shipment or inability of the consignee to produce the required documentation/ charges required by the customs authorities at destination country, the return carriage charges along with duty/ tax (if imposed) on that shipment shall be paid by the shipper at the time of returning. In case shipper Dense to pay the import courier/freight charges and duties (if imposed) MPEX has the right to destroy that shipment within 7 days after notifying to the shipper

The Shipper/Client acknowledges and accepts terms and conditions mentioned hereinafter and relieves & indemnify M&P Express Logistics (Pvt.) Limited along with all of its affiliated/associated/group companies (hereinafter referred to as “”M&P””) from all types of liabilities, responsibilities, claims, civil or criminal proceedings by any Government Agency, Suits, Petitions etc. against any damage, loss or expense suffered in connection with the services rendered hereunder and also agree that M&P is not the beneficiary of contents of shipments. M&P will only be responsible for the carriage of document/parcel which is the only function and responsibility of M&P.

M&P Consignment Note
The Consignment Note of M&P (CN/CWB/HAWB) is non-negotiable and the Shipper/Sender (s) acknowledges that it has been prepared by the Shipper/Sender (s) or by M&P staff on behalf of the Shipper. No Variation
These terms and conditions are applicable on all courier and logistics services provided by M&P to the Shipper/Client (s) hereunder. No employee, franchisee, agent of M&P or anyone else has any authority to change any of these terms and conditions, or make any promise on behalf of M&P which is in addition to or conflict with these Terms and Conditions.

Right of Inspection of Shipment
M&P has the right, but not the obligation, to inspect any shipment including without limitation opening the shipment if required by law and/or regulations. In this regard, the Shipper/Client agrees that M&P may open and inspect a shipment for any reason at any time.

Lien of Goods Shipped
M&P shall have a lien on any goods shipped for all freight Charges, Octroi, duties, advances or any other charges of any kind payable by the Shipper/Client (s) hereunder and may refuse to surrender possession of the goods until such charges are paid by the Shipper/Client (s).

  1. 5 Limitation of Liability:
    1. 5.1 Domestic/Banking Claim Liability
    2. 5.2 Maximum Liability on Non-Document shipments in case of total loss or total damage, PKR 1000.00 (Pak Rupees One thousand only) per shipment.
    3. 5.3 Maximum liability on Non-Document shipments in case of partial loss or partial damage, PKR 500.00 (Pak Rupees Five Hundred Only) per shipment or actual value of shipment, which ever is less.
    4. 5.4 In case of damage, the liability will be assessed on the affected material and the goods should be handed over to M&P, in lieu of payment against those goods.
    5. 5.5 Free of Cost (FOC) replacement of shipment of the same weight (where applicable)
    6. 5.6 Liability will be paid as per the actual cash value assessed mutually by customer and M&P.
  2. 6. Actual Value
    1. 6.1 The actual value of a document (which terms shall include any item of no commercial value which is transported hereunder) shall be ascertained by reference to its cost of its preparation or replacement, reconstruction, or reconstitution value at the time and place of shipment, whichever is less.
    2. 6.2 The actual value of a parcel (which terms shall include any item of commercial value which is transported hereunder) shall be ascertained by reference to its cost of preparation or replacement, release or fair market value at the time and place of shipment, whichever is less. In no event shall such value exceed the original cost of the article actually paid by the shipper.
  3. 7. Consequential Damages Exclude
    1. 7.1 M&P liability is strictly limited to direct loss and damage only. All other types of consequential losses are excluded (including but not limited to lost profits, income, interest, future business), even if the risk of such loss or damage was brought to M&P’s attention before or after acceptance of the shipment.
    2. 7.2 M&P shall not be liable to any consequential or special damages or other indirect loss. However, arising, whether or not M&P had knowledge that such damages might be incurred, including but limited to loss of income, profit, interest, use of contents or loss of market.
  4. 8. Liabilities Not Assumed
    1. 8.1 While M&P will endeavour to exercise its best efforts to provide expeditious delivery in accordance with regular delivery schedules, M&P will not, under any circumstances, be liable for delay in pickup, transportation or delivery of any shipment regardless of the cause of such delay. Further M&P shall not be liable if a shipment is lost, damaged or not delivered because of circumstances beyond one’s control these include.
      1. 8.1.1 Act of GOD: In the event a shipment is damaged, lost due to Act of GOD such:
        1. 8.1.1.1 Flood
        2. 8.1.1.2 Storms
        3. 8.1.1.3 Earthquakes OR any other unexpected natural occurrences.
      2. 8.1.2 Force Majeure / unforeseen Incidents: In the event a shipment is damaged or lost due to event such as: War, Strike, Riots, Embargo, and Crimes etc.
      3. 8.1.3 In case of insured shipments, the case / claim will be decided after assessment.
      4. 8.1.4 If shipment was booked as On Shipper Risk, claim will be declined, On Shipper Risk covers all kind of losses and damages.
  5. 9. No Liability on Shipments Containing Documents
    1. 9.1 Tender Documents
    2. 9.2 Shipping Documents (LC)
    3. 9.3 Photographs
    4. 9.4 Certificates
    5. 9.5 Educational Documents (Degrees)
    6. 9.6 Scratch Card (if blocked timely, M&P shall be liable only for reconstruction charges not denomination charges) if any card is used the company will bear the whole / negotiated amount of the same.
  6. 10. Acknowledgement of Shipper & Consignee:
  7. The Shipper/Sender (s) acknowledges that the consignment/shipment shall be transported by road and/or air and shall therefore be exposed to all risks associated with such mode of transportation. Subject to the aforesaid, M&P will endeavour to exercise its best efforts to provide expeditious delivery in accordance with regular delivery schedule; however, M&P will not under any circumstances be liable for delay in pick up, transport or delivery of any shipment regardless of the cause of such delay. Further M&P shall not be liable if shipment is lost, damaged, mis-delivered or not delivered because of circumstances beyond its control. These include;
    1. 10.1 Act of God for example earthquake, cyclone, storm, flood or "force majeure" for example war, plane crasher embargo or caused by mishap with M&P.
    2. 10.2 The act, default or omission of the Shipper/Client (s), the or any other party who claims an interest in the shipment (include violation of any terms and condition hereof) or any person other than M&P or of any Government officials or of the Postal service forwarded or other entity or person to whom a shipment is tendered by M&P for transportation to any location not regularly served by M&P regardless of whether the Shipper/Client (s) reported or had knowledge of such third-party delivery arrangements.
    3. 10.3 The nature of the shipment for any defect, characteristic, inherent vice thereof, even if M&P had knowledge when the Shipper/Client (s) accepted it.
    4. 10.4 Electrical or magnetic energy erasure or other such damage to electronic or photographic images or recording in any form.
  8. 11. Claims
    1. 11.1 Any claim must be brought by the Shipper/Client (s) and deliver in writing to the office of M&P nearest the location at which the shipment was accepted within 30 days of booking no claim shall be made against M&P outside of this time limit.
    2. 11.2 No claim for loss or damage will be entertained until all transportation charges have been paid. The amount of any claim shall not be deducted from any transportation charges owed to M&P.
    3. 11.3 M&P does not maintain records relevant to shipments for more than 45 days. Therefore, It will not be possible to refer to or produce any such record after expiry of the said period of 45.
  9. 12. Insurance
    1. 12.1 It is mandatory upon shipper to arrange for insurance of all shipment through M&P or any insurance company for entertaining claims. No claim will be entertained by M&P exceeding the amounts mentioned in clause (5.1) unless insured and value and contents declared on CN/CWB/HAWB. Shipments of undeclared value shall be accepted for carriage and delivery “On shipper’s Risk Alone”.
  10. 13. Lawfulness of Shipment/Goods
    1. 13.1 It is hereby undertaken and confirmed by shipper/client that the shipment/goods being stored/transported hereunder through M&P have been acquired by the Shipper/Client (s) lawfully and no law whatsoever has been breached in acquisition thereof. It is further undertaken and confirmed that all the relevant and necessary documents pertaining to the shipments/goods are in possession of Shipper/Client (s) who will be liable and responsible to provide all and any document as and when required by M&P for their onward submission to any Government Agency/Department/Authority etc.
    2. 13.2 It is further undertaken and confirmed by Shipper/client that the Shipper/Client (s) shall make himself and/or any documents whatsoever available at all material time and in the event that M&P and/or any Government Agency/Department/Authority etc. has any query in relation to all and any aspect of shipments/goods.
    3. 13.3 It is further undertaken and declared by shipper/client that M&P being only responsible for warehousing/transportation of shipments/goods of shipper, therefore shipper/client shall indemnify M&P against any liability, loss, claim, demand, action, proceeding etc.
    4. 13.4 It is further undertaken by shipper client that All shipments/items are legal commodity and is allowed by Pakistan and International law, and does not contain any banned/contraband & angerous/hazardous items.
  11. 14. Flash Messages
    1. 14.1 Shipper/customer has no objection if M&P send its promotional and operational messages on his/her given contact numbers/addresses.
  12. 15. Material Not Acceptable for Transportation
    1. 15.1 M&P will not accept negotiable instruments, Cash, Prize Bonds/Defence Saving Certificates, Negotiable Bonds, Antiques, Open/Bearer Cheques, Work of Art, Bullion, Jewellery, Negotiable Instruments, Stamps, Precious Metals/Stones, Liquor, Drugs, Loose Powder, Narcotics, Heroin, Dyes, Lubricants, Gums, Pastes, Magnetic Metals/Material, Liquid, Perishable Items, Grease, Glues, Battery Cell, Fire Arms & Explosive, Pornographic/Obscene Literature or banned or/and illegal medicines, Contraband/Smuggled goods and Imported/smuggled Medicines from India and any other country. IATA restricted articles, shipments/envelopes containing hate or threatening material against , President, Prime Minister, Governors, Ministers, MNAs, MPAs, High Officials of Govt., Judiciary, Armed forces, any religion, sect or against any individual, any group organization any item the carriage of which is prohibited by any law, regulation or statute of any provincial or federal Government of Pakistan & Mail/Parcels on P.O. Box Addresses. In compliance with Pakistan Post Office Act-1898, M&P would not accept letters or post cards as their carriage is the exclusive privilege of the federal government.
  13. 16. Taxes
    1. 16.1Applicable Government taxes, GST imposed by Local, Provincial and Federal Government of Pakistan will be applicable.
  14. 17. Rates
    1. 17.1M&P has the right to revise rates anytime without any prior intimation.
  15. 18. Proof of delivery
    1. Courier rider will get electronic signature of consignee/receiver on android based smart phone app. Electronic signatures will be sufficient proof that shipment has been delivered to consignee/receiver.

Terms and Conditions:

  • Customer needs to claim insurance the very next day of receiving shipment.
  • Maximum Limit of parcel, anyone sending per customer: PKR 300,000.
  • Deductible: 5 % of the value of the cargo declared.
  • Basis of Valuation: Declared value/ invoice value/ market value whichever is less.
  • Warranted this policy only to cover BRAND NEW ITEMS.
  • Cover will only be given to private sector companies. No cover for public enterprises.

  • Painting

  • Losses due to inherent vice, temperature variation & Force Majeure, mysterious and unexplained disappearance.
  • All perishable items
  • Software

Declaration Warranty:

Warranted that following details of each consignment booked for insurance should be sent on the next working day to the insurance company:

  • Consignment Note no.
  • Date of issue
  • Name of Customer
  • Details of Goods
  • Value

Premium Payment:

Premium collected should be deposited with the insurance company on a fortnightly basis.

Claims:

  • In the event of claim M&P Express Ltd. will intimate to EFU and EFU will process the claim as per policy. EFU will advise the amount payable.
  • M&P Express Ltd. will first pay that amount to their customer(s), and then claim from EFU by providing the evidence of payment.

Evidence Includes:

  • Copy of Cheque issued in the name of claimant.
  • Acknowledgement of the cheque from the claimant.
  • Salvage, if any.
